Terms of Service

These are the rules for using Warble. They are written to be read, not skipped. The short version: Warble drafts posts and publishes them to accounts you connect, you own what it makes for you, and you are responsible for what goes out under your name.

01Who we are

Warble is operated by UseWarble, LLC, a Florida limited liability company, at 124 N Nova Road #118, Ormond Beach, FL 32174. In these terms, "we", "us" and "Warble" mean that company.

"You" means the business using the service. If you sign up on behalf of a business, you are agreeing to these terms for that business, and you are confirming you are allowed to do that.

The service is provided through usewarble.com and the application at app.usewarble.com.

Warble is intended for businesses in the United States. We do not offer it to customers in the United Kingdom or the European Union, and it is not built for the rules that apply there. If you are outside the United States, please do not sign up.

02What Warble does

Warble is an AI social media manager for small businesses. You give it your website address. It works out what your business is about, writes posts in your voice, makes the images to go with them, and publishes them to the social accounts you connect.

The parts of the service

  • Website scan. You give us your website address. Our server fetches your homepage and up to three more pages on the same domain, reads the text, and uses AI to build a profile of your business — a summary, your industry, your audience, your current offer and call to action, and a set of content themes. We only fetch pages over a secure connection, and only on the domain you gave us.
  • Brand look. From the same pages we derive a rough brand kit — colours, type feel, logo, photography direction — used to style the images we make for you.
  • Content generation. AI writes post ideas and captions, and generates images, carousels and short videos. Different AI models handle different jobs. Section 9 lists who we send this to.
  • Scheduling and publishing. Posts you schedule are queued and sent to your connected social accounts through a third-party publishing provider.
  • Results. We pull back numbers from your connected accounts — follower counts, and per-post figures such as impressions, clicks and saves — and store them so you can see how a post performed over time.
  • Link tracking. If a post carries a Warble tracking link, we log each click on it so we can tell you how many people clicked.
  • Inbox. If you switch it on, Warble can collect comments and direct messages from your connected accounts and reply using a reply flow you have written yourself.
What Warble is not

Warble writes and schedules content. It is not a marketing strategist, a community manager, an advertising buyer, a lawyer or an accountant. Nothing it produces is professional advice of any kind.

03Early access

Warble is in early access. It is a real, working product that people use every day, but it is not finished.

That means features will be added, changed and removed, sometimes at short notice. Some things will not work as well as they should. Prices are not final. We may pause or change parts of the service while we fix them.

We tell you this up front because it is fair to. If you need a service that never moves underneath you, Warble is not that yet.

04Who can use Warble

You may use Warble if:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a contract.
  • You are using it for a business. Warble is a business tool, sold to businesses. Please do not sign up for personal use.
  • You are not barred from using the service under the laws that apply to you, and you are not on a sanctions list.

You also have to meet the rules of every social platform you connect. Each platform sets its own minimum age and its own eligibility rules, and we cannot waive them for you.

05Your account

To use Warble you create an account. Sign-in is handled by Clerk, our identity provider, which holds your login details and verifies who you are. Warble never sees or stores your password.

Keeping your login secure is your job. Do not share it. Use a strong, unique password, and turn on any extra sign-in protection your provider offers. If you think someone else has got into your account, email us straight away at hello@usewarble.com.

Everything done through your account is treated as done by you — including anything published.

If your account has more than one member, every member can act for your business inside Warble. It is your job to decide who gets access, and to remove people who should no longer have it.

06What you may not use Warble for

Do not use Warble to create, schedule or publish content that:

  • Breaks the law — anything unlawful where you are, where we are, or where the content is published.
  • Deceives people — false claims about what a product does, invented reviews or testimonials, fake results, fake urgency or scarcity, or anything designed to mislead someone into buying or handing over money or data.
  • Impersonates someone — pretending to be another person, business or organisation, or suggesting you are endorsed by or affiliated with someone when you are not. This includes putting words in a real person's mouth, and generating the likeness or voice of a real person without their permission.
  • Uses other people's work without the right to — copyrighted images, music, video or text, or someone else's trade marks, logos or brand.
  • Targets or harms people — harassment, threats, hate speech, content that sexualises minors, or content that encourages self-harm or violence.
  • Is regulated content you are not licensed to publish — for example medical, financial, legal or investment claims you are not authorised to make.
  • Is spam — bulk unsolicited messaging, engagement farming, or automated behaviour designed to game a platform.

Also, do not:

  • Scan a website you do not own and are not authorised to act for.
  • Connect a social account you do not own and are not authorised to manage. If you are acting for a client, read section 7.
  • Try to break, overload, reverse engineer or get around the technical limits of the service, or reach parts of it you were not given access to.
  • Resell Warble, or put your own brand on it and sell it as your own product, unless we have agreed that with you in writing.
  • Use the service in a way that breaks the terms of any platform you have connected.

We do not pre-screen or approve what you publish. If we become aware of content or behaviour that breaks these rules, we may remove content, disconnect accounts, or suspend or close your account. See section 17.

07Running Warble for a client

Agencies, freelancers and consultants are welcome to use Warble to run social accounts for their clients. This is allowed, and we build for it.

Two conditions come with it.

  • You must have your client's permission. Permission to scan their website, to connect their social accounts, and to publish on their behalf. Every time you connect an account or scan a site that is not your own, you are confirming to us that you have that authority.
  • You stay responsible. Everything published from your Warble account is yours under these terms, whoever it was published for. Section 8 applies to you exactly as it applies to a business posting for itself. If a client disputes a post, that is between you and them.

Our agreement is with you, the account holder. We do not have a contract with your client, and we will not deal directly with them about your account. If a client wants their own Warble account, they are welcome to open one.

Reselling Warble itself, or putting your own branding on it and selling it as your product, is a different thing, and needs our agreement in writing first.

08You are responsible for what gets published

This is the most important section on this page. Warble drafts. You decide. What goes out under your brand is yours, and so are the consequences.

AI writes the posts and makes the images. AI gets things wrong. It can invent a fact, state a claim about your business that is not true, misread your website, or produce an image that does not reflect reality. Read every post before it goes out.

How approval works today

Nothing publishes on its own. Warble produces drafts. A post is only queued for publishing once someone on your side schedules it, and it then goes out at the time you chose.

If we ever offer an unattended mode — where Warble schedules and publishes without you looking at each post first — it will be something you switch on deliberately, and switching it on will not move responsibility to us. Everything published from your account stays yours.

What this means in practice

  • You confirm that any claim in a post is one your business can actually stand behind.
  • You are responsible for any disclosure the law requires you to make — advertising labels, affiliate disclosures, results disclaimers, licence numbers.
  • You are responsible for having the rights to every image, logo, name, likeness and piece of music in your posts.
  • You are responsible for following the rules of each platform you publish to.

If a post causes a complaint, a takedown, a regulatory action, a platform ban or a claim from someone else, that is between you and them. You agree to cover our reasonable costs, losses and legal fees arising out of content published through your account, or out of your breach of these terms.

09Who owns the content

You own what Warble makes for you. The posts, captions, images, carousels and videos generated for your business are yours. To the extent we hold any rights in them, we transfer those rights to you as soon as they are created, free of charge.

You also keep everything you brought with you: your website content, your logo, your brand, your photos, your product information, and anything you upload or type in.

We keep ownership of Warble itself — the software, the interface, our designs and templates, our prompts, our name and our logo. Using the service does not give you any rights in those, beyond the right to use the service.

The permission you give us to run the service

To do its job, Warble has to move your material around. So you give us permission — a licence — to host, store, copy, adapt, resize, crop, translate and transmit your website content, brand assets, uploaded media, the text you write and the content we generate for you, for the purpose of running the service for you. Section 10 covers the one other use we ask for.

That permission is worldwide, because the internet is. It costs nothing. It lasts while you use the service, plus a short period afterwards so we can finish anything in flight and let backups age out. It ends when your account and data are deleted.

Who else sees your material

Running the service means sending parts of your content to companies we rely on. Today those are:

Each of these has its own terms and its own way of handling data. The Privacy Policy sets out what is sent to whom and why, and it is the current version of this list — providers can change as the product changes.

We do not train our own AI models on your content.

One honest caveat

Under United States law, material generated by AI without meaningful human authorship may not be protected by copyright at all. That is a limit of the law, not something we can grant you or take away. In practice it means you may not be able to stop someone else using a similar AI-generated image. We are telling you because it is true, not as legal advice.

10Showing your work as an example

We want to be able to show people what Warble actually produces. So you give us permission to display content generated on the platform as examples of the product.

What this covers

  • Posts, captions and images generated in Warble for your business.
  • The brand look Warble derived from your website — colours, type feel, art direction — as it appears in those generated posts.
  • Showing them on our website, in our own social posts, in demos, in decks and in our advertising.

Because a generated post normally carries your business name and brand, an example may show them. That is what the example is. If you would rather it did not, opt out below.

What this does not cover

  • Photographs and video you uploaded yourself. Those stay entirely yours. We will not use them as examples — and we will never use an upload showing an identifiable person.
  • Comments, direct messages or anything else your customers sent you.
  • Your account data, your analytics, your credit history, or anything else from inside your workspace.
  • Presenting you as endorsing Warble, or quoting you as a testimonial or case study. That needs your agreement first, every time.

How to opt out

Email hello@usewarble.com and say you do not want your content used as an example. That is the whole process. You do not need to give a reason, and it makes no difference to your account or your pricing.

We will stop using your content as an example going forward, and remove it from anywhere we control. The one thing we cannot undo is a copy that has already been printed, or something already reshared by someone else — that is outside our reach, and we will not pretend otherwise.

11Media you upload

You can upload your own photos and video to use in posts. Before your first upload you confirm that you own or are licensed to use everything you upload, and that Warble may use it to make and publish your content. That confirmation applies to every upload afterwards.

Screening

Warble has automatic screening for uploaded images, which checks for explicit or unlawful imagery. Screening may be applied to your uploads. Do not assume it has been. It is not switched on for every installation of the product, it may not run on every upload, and it can be wrong in both directions.

It is not a guarantee of anything. It does not certify that an image is lawful, that you have the rights to it, that it is safe to publish, or that it meets any platform's rules. Responsibility for what you upload stays with you.

What not to upload

  • Anything you do not have the rights to.
  • Anything featuring a person who has not agreed to appear in your marketing.
  • Anything unlawful.

Uploaded and generated media is stored with our hosting provider and served from a public web address. That address is hard to guess, but it is not password-protected — this is how a social platform fetches the image when a post publishes. Do not put anything confidential in a post image.

12Connected social accounts

Warble can publish to Instagram, Facebook, LinkedIn, X, TikTok, Threads, YouTube, Pinterest, Bluesky and Google Business.

You connect those accounts yourself. The connection is made through our publishing provider rather than by Warble directly: you are sent to an authorisation page, and you grant access there. That gives Warble permission to post on your behalf, to read back results, and — if you switch the inbox on — to read comments and messages.

  • Those platforms are not us. Each has its own terms, its own content rules and its own decisions. You must follow them. If a platform suspends your account, removes a post, limits its reach or changes its rules, that is the platform's decision and outside our control.
  • Connections break. Access expires, platforms change their APIs, accounts get disconnected. When that happens, posts can fail to publish. We will show you the failure. We cannot promise it will not happen.
  • Only connect accounts you are allowed to manage. See section 7 if you are acting for a client.
  • You can disconnect at any time. When you do, we delete our record of that connection immediately and, where the provider supports it, revoke the access at their end as well. You can also revoke Warble's access from inside the platform's own settings, and doing both is the safest option. Once disconnected, scheduled posts to that channel will not go out.

Some platforms have extra requirements we cannot work around. A Google Business profile has to be verified before it can publish, and several channels will not accept a text-only post.

13Compliance screening

Read this section carefully, because it is easy to assume this feature does more than it does.

Warble includes a compliance screen for post copy. When we generate text, it runs that text through a set of pattern-matching rules and flags language that often causes trouble — earnings claims, health claims, guarantees, superlatives, missing disclosures. You can add an industry pack for stricter rules in your field. Where it can, it suggests safer wording, and if you switch that option on it will rewrite a flagged claim before the post is scheduled.

What the compliance screen is not

It is not legal advice. It is a set of text rules written into our software. It knows nothing about your business, your licences, your regulator or your state.

It is not a guarantee of compliance. It does not certify that a post is lawful, that it meets advertising rules, or that it is acceptable to any regulator or platform.

It will miss things. The rules look for particular words and phrases. A claim written in words the rules do not cover passes without a flag. A clean pass means "nothing matched our rules" — it does not mean "this is safe to publish".

It will also flag things that are perfectly fine. The rules are deliberately cautious. A flag is a prompt to look, not a verdict.

It never blocks a post. You can publish flagged copy. The decision is always yours.

If your business is regulated, you need proper advice from someone qualified in your field and your state. Do not treat this feature as a substitute for it. We accept no liability for a post that was screened and still caused a regulatory, advertising-standards or platform problem.

14Availability, and no warranty

We want Warble to be up all the time. We do not promise that it will be.

The service depends on things we do not control: the social platforms and their APIs, our AI providers, our publishing provider, our hosting, and your own website being reachable. Any of them can be slow, rate-limited or down.

In practice this means a scheduled post can be delayed or fail to publish, a generation can fail, and results data can be incomplete or arrive late. We will show you when something has failed so you can act on it, but we do not guarantee that any particular post will publish at any particular time. We do not offer an uptime commitment.

We may take the service down for maintenance, and we may change or remove features. Where a change is significant and planned, we will try to give notice.

No warranty

Warble is provided "as is" and "as available". As far as the law allows, we make no promises about it beyond what is written in these terms. In particular, we do not promise that:

  • The content generated will be accurate, original, suitable, effective or compliant.
  • Posting through Warble will produce followers, engagement, leads or sales.
  • The service will be uninterrupted, secure or error-free.
  • Any particular fault will be fixed within any particular time.

Some laws give you rights that cannot be excluded. Nothing here removes those.

15Limits on our liability

We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

Subject to that, and as far as the law allows:

  • We are not liable for lost profits, lost revenue, lost business, lost data, lost goodwill or reputational harm.
  • We are not liable for the consequences of content published through your account — including complaints, takedowns, platform suspensions, regulatory action or claims by other people.
  • We are not liable for anything caused by a social platform, an AI provider, our publishing provider or any other third-party service.
  • Our total liability to you, for all claims taken together, is capped at the greater of: the fees you paid us in the 12 months before the claim, or $100.

Nobody is being charged today, so for most accounts that cap is $100. We would rather say that plainly than bury it.

16Credits and billing

Billing is not switched on

Warble is not charging anyone today. There is no payment processor connected to the product, no card on file and no subscription to cancel. Nothing in this section applies to anyone right now.

Before we take a first payment we will publish final prices and tell you, and you will have to choose a plan yourself. You will not wake up to a charge.

How credits work

Warble meters usage in credits. A credit is a unit of AI generation. Roughly: one image is one credit, a larger or higher-quality image costs more, and text generation such as an idea or a caption is a fraction of one. The exact cost of each action is shown in the app, and it can change as the underlying AI models and their prices change.

Today credits are counted, but nothing is enforced and nothing is charged. Generating content does not cost you money.

How billing will work when it starts

  • Credits roll over. Credits you have not used carry into the next month, and keep carrying over for as long as your subscription is active. They are not wiped at the end of a billing cycle.
  • There are no refunds. Payments are not refundable, in whole or in part, including for a part-used month. If you cancel, you keep your access and your credits until the end of the period you have already paid for.
  • Credits you have already spent cannot be refunded. A generation you asked for and received has cost us money at the AI provider, whether or not you liked the result. Where a generation fails because of a fault on our side, we put those credits back automatically — that is not a refund of money, it is the credit returning to your balance.
  • Credits have no cash value. They cannot be transferred between accounts and cannot be exchanged for money. They end when your account closes.

If we change prices, we will tell you before the change affects you, and you will be able to cancel rather than accept it.

17Suspension and closing your account

You can leave whenever you want

Stop using Warble at any time. To close your account, email hello@usewarble.com. Disconnect your social accounts first if you want to be certain nothing further is sent.

We can end it too

We may suspend or close your account if you break these terms, if your use puts us or the service at legal or security risk, if a platform or provider requires it, or if we stop offering the service. Where it is reasonable to do so, we will warn you first and give you a chance to put it right. Where the risk is serious, we may act immediately.

What happens to your content

  • Posts already published stay published. They live on the platform under your account, not with us, and we cannot take them down for you.
  • Scheduled posts that have not gone out will not be sent.
  • Your website scan, brand profile, generated posts and media are kept for as long as your account is open, and are deleted within 30 days of it closing. Export anything you want to keep before then.
  • Connected accounts are cut immediately. Disconnecting a channel, or closing your account, removes our record of that connection straight away.

The Privacy Policy has the detail on what we hold and for how long.

18Changes to these terms

We will update these terms as the product changes. When we do, the "last updated" date at the top of this page changes with them.

If a change materially affects your rights — a change to pricing, to liability, or to how your content is used — we will email you before it takes effect.

If you keep using Warble after a change takes effect, that counts as accepting it. If you do not accept it, stop using the service and close your account.

19Governing law and where disputes go

These terms are governed by the law of the State of Florida, without regard to its conflict-of-laws rules.

Any dispute arising out of these terms or the service goes to the state and federal courts located in Volusia County, Florida. You and we both agree to those courts.

There is no arbitration clause in these terms. We have deliberately not put one in. If something goes wrong between us and we cannot sort it out, it goes to court like any other disagreement.

Please come to us first, at hello@usewarble.com. Most problems are a misunderstanding, and almost all of them are cheaper to fix by email.

If any part of these terms turns out to be unenforceable, the rest of them still applies.

These terms, together with the Privacy Policy, are the whole agreement between us about the service.
